CONSTITUTION OF UKRAINE

 

ARTICLE 118. The executive authority of the regions and districts, the cities of Kiev and Sevastopol is realized by the local state administrations.

The special laws of Ukraine assign particularities of the executive authority realization in the cities of Kiev and Sevastopol.

The chairmen of the local state administrations form the structure of the local state administrations.

The chairmen of the local state administrations are assigned to a position and dismissed from a position by the President of Ukraine with the statement of the Council of Ministers of Ukraine.

The chairmen of the local state administrations, when realizing their authorities, are responsible to the President of Ukraine and the Council of Ministers of Ukraine, are accounted and controlled by the executive authorities of the higher level.

The local state administrations are accounted and controlled by the councils in some authorities that are deputed by the proper district or regional councils.

The local state administrations are accounted and controlled by the executive authorities of the higher level.

The President of Ukraine or the chairman of the local state administration of the higher level can rightfully cancel any decisions of the chairmen of the local state administrations, which contradict to the Constitution and the laws of Ukraine, and the other legislative statutes.

The regional or district council can show distrust to the chairman of the proper local state administration, and the President of Ukraine makes a decision and gives a reasonable reply based on the case.

If the two thirds of the deputy’s council show distrust to the chairman of the district or regional state administration, the President of Ukraine makes the decision of dismissal of the chairman of the local state administration.

ARTICLE 119. Local state administrations within their relevant territory ensure:

1) the implementation of the Constitution and laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, and other organs of executive authority;

2) lawfulness and law and order; safeguarding the rights and freedoms of citizens;

3) the implementation of state and local programs of socioeconomic and cultural development, environmental protection programs, and in areas of the compact residence of indigenous peoples and national minorities - programs of their national-cultural development as well;

4) the development and implementation of the relevant provincial and regional budgets;

5) reporting on the implementation of relevant budgets and programs;

6) cooperation with organs of local self-government;

7) implementation of other responsibilities delegated by the State, as well as by the relevant councils.
 



In accordance with the Constitution of Ukraine, modern Sevastopol is a city of national importance under the Central Government. There are 4 administrative districts: Balaklavskyy, Gagarinskyy, Leninskyy, Nakhimovskyy, as well as the city of regional subordination - Inkerman, and 29 villages and settlements.

Until 1948 Sevastopol was a city of regional subordination. October 29, 1948 under the decree of the Presidium of the Verkhovna Rada of the RSFSR Sevastopol was recognized as a separate administrative and economic center with its own budget. In connection with the transfer of the Crimea region on 19 February 1954 in the territorial-administrative subordination of the USSR, Sevastopol remained a city of republican subordination in the Ukraine.

In 1991, after the proclamation of independence of Ukraine, Sevastopol became the Ukrainian city under central authority. In March 1995, it was removed from the Crimean autonomous republic, and declared the city under the Central Government’s "special status", which is stipulated for in the adopted in June 1996 Constitution. Parameters of the special status of the city should be stipulated for in the law of Ukraine "On the status of Hero City of Sevastopol, which is pending in Parliament.

 

The city’s Legislature is the City Council. Executive power is exercised by the city state administration. Chairman of the City State Administration is appointed by the President of Ukraine. Vladimir Yatsuba was appointed the chairman of Sevastopol city state administration by Decree of President of Ukraine №651 from 07/06/2011.

Four districts of the city - Balaklavskyy, Gagarinskyy, Leninskyy and Nakhimovskyyare managed by district administrations headed by chairmen who are appointed by the President of Ukraine.

Local government is carried out by Sevastopol City Council and district councils, headed by their chairpersons who are elected from among the councilors. Inkerman City is part of the Balaklavskyy district with the status of district subordination, is headed by the mayor. There are also four rural Councils: Andriyivskyy, Verhnesadovskyy, Orlynovskyy, Ternovskyy. Township and village councils are headed by a popularly elected heads.
